TERMS AND CONDITIONS OF SALE

The products on sale on www.oscilab.it (hereinafter the “ Site ”) are sold and invoiced by Balma Srl, with headquarters in Via Amatore Sciesa, 2/A  Milan, company registered with the Chamber of Commerce of Milan at no. REA 2685106 of the Company Register, CFP VAT no. 12804700966.

1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 Balma srl ​​offers products for sale on the Site to end consumers, i.e. to individuals who purchase for purposes not related to their own commercial, entrepreneurial or professional activity, if any (the “ Customer ”). Balma srl ​​therefore reserves the right not to follow up on orders from individuals other than the “consumer” or in any case on orders that do not comply with its commercial policy.

1.2 The contract stipulated between Balma  (hereinafter also the " Seller ") and the Customer must be considered concluded with the acceptance, even partial, of the order by Balma. In the event of non-acceptance of the order, Balma srl  will in any case promptly inform the Customer.

1.3 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the " Order "), the Customer declares that he has read all the information provided to him during the purchase procedure and that he fully accepts these general conditions (hereinafter the " Conditions ").

1.4 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. Purchase methods

2.1 The products offered for sale by Balma srl  are only those present on the Site at the time the Order is placed, as described in the relevant information sheets.

2.2 In any case, it is understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in colour and size (also due to the browser and monitor used to access the Site and view the images).

2.3 To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it, following the instructions on the Site, after having carefully read the Conditions, as well as the characteristics of the product and/or products that he/she intends to purchase, the price (including all applicable taxes or duties) and shipping costs (including any additional costs to be incurred for having chosen a type of shipping and delivery different and/or faster than the standard one). The Customer must also request from Balma srl, if desired, the issuing of a tax invoice relating to the purchase.

2.4 Correct receipt of the Order is confirmed by Balma srl  by means of an e-mail response, sent to the e-mail address communicated by the Customer. This confirmation message will briefly report the conditions of purchase, as required by applicable law, as well as the data entered in the Order by the Customer, so that the Customer can verify the same and possibly communicate without delay the necessary corrections of incorrect data.

3. Prices and Payment Methods

3.1 The prices indicated on the Site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the Site.

3.2 Purchases can only be made by credit card, bank transfer and via PayPal, Klarna  and the transaction will take place through a secure server chosen by Balma srl.

3.3 In no case and at no stage of the payment will Balma srl  will be able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the site of the banking institution that manages the transaction. No computer archive of Balma  will retain such data and therefore in no case Balma  may be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.

4. Delivery of products and related costs

4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within the times indicated in the Order itself, by Balma  and its logistics service providers, at the cost specifically indicated on the Site before sending the Order. Balma reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.

4.2 For deliveries requested in countries outside the European Union, any import customs charges will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of his/her country in advance to verify the costs and any import limits.

4.3 The delivery times indicated by Balma  must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.

4.4 Upon delivery of the products, the Customer is required to sign the delivery note after having duly checked:

4.4.1 that the number of packages delivered corresponds to that indicated in the transport document.

4.4.2 that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).

4.5 Any damage to the packaging and/or the product or any discrepancy in the number of packages or indications must be immediately reported by making a specific note on the delivery document of the product to be returned to the courier.

4.6 Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery.

5. Right of withdrawal

5.1 The Customer may withdraw from the purchase contract for any reason, without having to provide reasons and without any penalty, within 30 (thirty) days from the date of delivery of the products.

5.2 To exercise the right of withdrawal referred to in the previous article 5.1, the Customer may contact customer service via email.

5.3 In case of withdrawal the Customer must return the products to Balma  within 30 (thirty) days of the withdrawal itself, according to one of the following methods, at the Customer's choice:

5.3.1 sending the product/products to be returned to the indicated address  via the courier chosen by Balma  (this return method will be paid by the Seller and therefore will not entail any costs for the Customer);

5.3.2 sending the product/products to be returned to the address indicated via a courier chosen directly by the Customer (in this case the Customer will bear all shipping costs);

5.4 The goods must be returned intact, complete with all their parts and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being any signs of wear or dirt, in compliance with the conditions set out below:

  • the right of withdrawal may be applied to the product purchased in its entirety; it is not in fact possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, complements, etc.);
  • for withdrawal to be possible, the product must be intact and complete in all its parts (including the accessory equipment: labels, tags, seals, etc...);
  • the shipment, until the certificate of receipt in the warehouse indicated by Balma, is under the complete responsibility of the Customer;
  • in the event of damage to the goods during transport, Balma will notify the Customer, to allow him to promptly file a complaint against the courier and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously cancelling the request for withdrawal;
  • Balma will not be liable in any way for damage, theft, loss occurring during or in any way dependent on the return shipment.

5.5 Balm  will refund the Customer the amount of the products paid, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed. Balma  may suspend the refund until the returned product is received and pending  Customer demonstrates having correctly returned the product.

5.6 After the return of the products, Balma will carry out the necessary checks relating to their conformity to the conditions and terms indicated in this article and in the event that the checks are not concluded positively, the Seller will communicate to the Customer, via email, the existence of a decrease in value of the returned products, resulting from failure to comply with the aforementioned conditions. At the same time, Balma  will communicate the amount that will be deducted from the refund, without prejudice, alternatively, to the possibility for the Customer to obtain, at his own expense, the products in the state in which they were returned to Balma.

5.7 In the event of forfeiture of the right of withdrawal, Balma will return the purchased product to the sender, charging the latter the shipping costs and, if already refunded, the price of the product.


6. Complaints and requests for information

7.1 Any complaints or requests for information may be addressed to Balma  at the following Customer Service addresses:

7.1 The personal data collected with the forwarding of the Order will be processed in order to satisfy the express requests of the Customer, in compliance with Legislative Decree 196/2003 and the Privacy Policy of Sale present on the Site. Any further processing will be carried out only with the express consent of the Customer.

8. Applicable law

8.1 The sales contract referred to in these Conditions and its execution are governed by Italian Law, with the non-application of the conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. The Court of the municipality of residence of the Customer will be competent for the resolution of the related disputes.

8.2 In the event of disputes arising from the Conditions, the online Alternative Dispute Resolution body of the Milan Chamber of Commerce may also be consulted in advance.

8.3 Finally, we inform you that the European Commission provides a platform for the alternative extrajudicial resolution of disputes, including cross-border disputes, accessible on the website http://ec.europa.eu/odr.
